Kazakhstan Courts & Litigation
Bond Stone represents international investors, creditors, and companies in Kazakhstan state court proceedings — commercial courts, administrative courts, appellate courts, cassation courts, and the Supreme Court. Bond Stone’s litigation team advises on pre-trial demand procedures, manages multi-instance state court proceedings, and enforces judgments against Kazakhstani counterparties and state bodies. Ranked Legal 500 EMEA and IFLR1000.
Kazakhstan’s court system has undergone significant reform in recent years. A new administrative court system was introduced for disputes between private parties and state authorities — covering tax, customs, environmental, antimonopoly, and licensing disputes. Since 1 July 2025 cassation has moved from the Supreme Court to separate cassation courts. Supreme Court Normative Resolution No. 3 of 2 November 2023 clarified that an arbitration agreement must contain details identifying the chosen arbitration; if it does not, and no gap-filling rule such as the European Convention on International Commercial Arbitration applies, the agreement is treated as not concluded — meaning state courts retain jurisdiction over a broader range of commercial disputes than many international investors expect. For cross-border transactions involving Kazakhstani counterparties, understanding when state courts will have jurisdiction and how to navigate the pre-trial demand procedure is essential before any dispute escalates.
Bond Stone’s litigation practice is led by Alel Aliasheva, Partner, who specialises in commercial litigation, insolvency proceedings, and debt enforcement in the Kazakhstani state courts. The team handles proceedings from the Specialised Inter-District Economic Courts through the appellate and cassation instances to the Supreme Court of Kazakhstan.

Kazakhstan Court Litigation Services
Commercial Court Litigation
Representing international clients in the Specialised Inter-District Economic Courts in Almaty and Astana — breach of contract claims, unpaid debt recovery, shareholder disputes, corporate restructuring proceedings, and interim injunctive relief applications. Bond Stone manages the full litigation cycle from statement of claim through to judgment and enforcement.
Pre-Trial Demand Procedure — Compliance
A pre-trial procedure must be completed before filing where a law prescribes one for the category of dispute or the contract provides for it (Civil Procedure Code, Art. 8(6)). Where one applies, non-compliance results in return of the claim (Art. 152(1)(1)) or, if discovered after acceptance, the claim being left without consideration (Art. 279(1)). Bond Stone drafts, serves, and documents pre-trial demands for international creditors — ensuring procedural compliance before any judicial filing. See: Debt Collection in Kazakhstan →
Administrative Court Litigation
Representing foreign investors and companies in Kazakhstan’s administrative courts — disputes with the tax authority, customs committees, environmental regulators, the APDC (antimonopoly authority), licensing bodies, and the Ministry of Justice. Kazakhstan’s administrative courts take an active role in the case, including in gathering evidence. Bond Stone advises on administrative court strategy from the initial claim through enforcement of judgments against state authorities.
Interim Injunctive Relief
Advising on and obtaining interim injunctive relief in Kazakhstan state courts — asset freezing orders, prohibition on share transfers, injunctions restraining disposal of property, and interim orders preserving the status quo pending substantive proceedings. Bond Stone has obtained interim injunctive relief in shareholder disputes and asset recovery matters in the Almaty court system.
Appellate & Cassation Proceedings
Managing appellate proceedings before the appellate panels of the regional and equivalent courts and cassation proceedings in the Cassation Court for Civil Cases, which took over cassation from the Supreme Court on 1 July 2025. Property claims below 30,000 monthly calculation indices for legal entities and 2,000 for individuals cannot go to cassation on a party’s complaint; this limit is due to end on 1 July 2027 (Civil Procedure Code, Art. 434). Bond Stone advises on the grounds for appeal, procedural timelines, and strategic management of multi-instance proceedings for international clients whose first-instance judgments require challenge or who are defending against appeal by a Kazakhstani counterparty.
Insolvency & Rehabilitation Proceedings
Representing creditors in Kazakhstan bankruptcy and rehabilitation proceedings — proof of claim filing within statutory deadlines, participation in creditors’ meetings, challenge of rehabilitation administrator decisions, monitoring of asset preservation during the moratorium period, and appeal of rehabilitation plan provisions. Bond Stone advises on the intersection of the Rehabilitation and Bankruptcy Law with sector-specific regulation in construction, energy, and financial services. See: Corporate & Commercial Law →
Judgment Enforcement
Enforcing Kazakhstan court judgments against debtor assets — working with court bailiffs, applying for attachment of bank accounts and real property, and coordinating enforcement across multiple Kazakhstani asset classes. Bond Stone advises on enforcement strategy including priority between multiple creditors and enforcement against state-owned enterprise assets. See: Enforcement of Foreign Judgments →
State Court vs Arbitration — Strategic Advisory
Following Supreme Court Normative Resolution No. 3 of 2 November 2023, an arbitration clause that lacks details identifying the chosen arbitration, where no gap-filling rule applies, is treated as not concluded — meaning state courts retain jurisdiction even where an arbitration clause exists. Bond Stone advises international clients on the strategic choice between Kazakhstan state courts, domestic arbitration (Atameken), AIFC Court, and international arbitration — and on the enforceability of existing arbitration clauses in Kazakhstani counterparty contracts.
